SpikeTrendWatch is an automated information service. It aggregates public search-trend data, headlines, pictures and links published by independent third parties, official travel advisories, weather data, and embedded videos hosted by third-party platforms, and adds automated measurements (the Pulse, alert levels, rankings).
3. No guarantee of accuracy
Third-party news, trend, advisory and weather data are provided by their original sources. We do not create, verify, endorse or guarantee the accuracy, completeness, timeliness or reliability of any third-party content, and we are not responsible for errors or omissions in it. Automated measurements and labels (including the Pulse, alert colors, “Hot right now” rankings and topic or country assignments) are generated by software from that data, may be incomplete or wrong, and can change at any time. Always check the original source, and for travel decisions always check the official advisory of your own government.
4. Not advice
Nothing on SpikeTrendWatch is news reporting by us, or financial, investment, legal, medical, safety or travel advice. Do not rely on it to make decisions.
5. Third-party content and links
Headlines, pictures and videos belong to their publishers and creators and link to the original source. We do not control and are not responsible for third-party websites, content, products or services, or their privacy practices. Embedded videos play under the terms of the platform that hosts them.
6. Acceptable use
You may read and share links to any page. You may not scrape, bulk-download or systematically copy the site, overload or interfere with it, attempt to bypass security, or use it for any unlawful purpose.
7. Copyright notices
We respect intellectual property. If you believe material shown or linked on SpikeTrendWatch infringes your copyright, email contact@spiketrendwatch.com with: your contact details; the work; the page address; a statement of good-faith belief that the use is not authorized; and a statement, under penalty of perjury, that the information is accurate and that you are the owner or authorized to act for the owner. We remove or disable infringing material promptly.
8. Disclaimer of warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT. We do not warrant that the service will be uninterrupted, error-free or secure.
9. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, SPIKETRENDWATCH AND ITS OWNER WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA OR GOODWILL, ARISING FROM YOUR USE OF OR RELIANCE ON THE SERVICE OR ANY THIRD-PARTY CONTENT. OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO ONE HUNDRED U.S. DOLLARS (US$100).
10. Indemnity
You agree to indemnify and hold SpikeTrendWatch harmless from claims arising from your misuse of the service or breach of these Terms.
11. Changes
We may change the service or these Terms at any time. Continued use after changes take effect means you accept them.
12. Governing law
These Terms are governed by the laws of the Commonwealth of Massachusetts, United States, without regard to conflict-of-law rules. Courts located in Massachusetts have exclusive jurisdiction, except where your local consumer law gives you rights that cannot be waived.
